Individuals from other countries who come to New Jersey and wish to stay will have to obtain a visa. If you are a victim of a crime in your home country, the U non-immigrant visa could be available for you.

What are eligibility requirements for the U non-immigrant visa?

If you are interested in immigration to the United States through the U non-immigrant visa, you should know how to meet eligibility. You may be eligible if the following applies to you:

  • You’re the victim of certain types of criminal activity.
  • You suffered great mental or physical abuse after being the victim of a crime.
  • You have information about the crime. Those younger than 16 or who cannot provide information about the crime due to disability can have a parent, guardian or friend provide information about the crime on their behalf.
  • You helped, are helping or will help law enforcement during the investigation of the crime and the prosecution of it. People younger than 16 or who cannot give information or are disabled can have a parent, guardian or friend do this for them.
  • The criminal activity happened in the U.S. and was against the law.
  • You’re admissible to the U.S. However, if you aren’t admissible, you can apply for a waiver through Form I-192.

How can you apply for the U non-immigrant visa?

To begin the process of immigration into the United States, you will have to apply for the U non-immigrant visa. This process includes the following:

  • Fill out Form I-918, which is the petition for U non-immigrant status. You should also include Form I-918 Supplement B, which is a status certification form. This form must be signed by an official from a law enforcement agency who confirms that you are helping them in investigating and prosecuting the crime in question.
  • If you are inadmissible, you must fill out and file Form I-192 and request a waiver of inadmissibility.
  • You should include a statement that details the crime and how you were a victim of it.

Always be thorough when filling out all of the necessary forms so that your application isn’t denied on a technicality. Once your paperwork is in order, you will be closer to obtaining a visa.
